The Court of Appeal presided by Justice O. F. Omoleye has declared Mr Avine Agbom of the All Progressives Congress, APC as the duly elected members representing Makurdi North constituency at the Benue State House of Assembly.
The Justice therefore ruled that the certificate of return issued to Mr Martins Aza of the Peoples Democratic Party, PDP be withdrawn and a fresh one issued to Mr Agbom as the winner of the elections in the constituency.
The Court of Appeal which sat in Makurdi arrived at the decision after setting aside the judgement of the national and state assembly elections tribunal which ordered the Independent National Electoral Commission, INEC to conduct fresh elections in 20 polling units in Agan and 14 polling units in Mbalan council wards of the constituency within 60 days from the date of pronouncement.
The Presiding Judge while delivering judgement said, Mr Agbom, having proven his petition at the lower court, ought to have been declared winner rather than granting a relief which was not sought for by ordering a fresh elections.
This is the second time Mr Avine Agbom will win elections at the tribunals in a similar circumstance.
